1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "you", "your") and HYDRAX Nutrition Pty Ltd (ABN pending) ("HYDRAX", "we", "us", "our"), governing your access to and use of the HYDRAX website, products, and services.

By accessing our website, placing an order, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use our website or services.

2. Eligibility

You must be at least 18 years of age to purchase products from HYDRAX. By placing an order, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.

If you are under 18, you must have a parent or guardian review these Terms and place an order on your behalf.

3. Accuracy of Information

While we make reasonable efforts to ensure accuracy, we are not responsible if information on this site is not accurate, complete, or current. All materials are provided for general information only.

Occasionally there may be information on the site that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, or availability. We reserve the right to correct any errors and to change or update information or cancel orders if any information is inaccurate, at any time without prior notice (including after you have submitted your order).

4. Products & Product Information

We make reasonable efforts to display accurate product descriptions, images, ingredients, nutritional information, and pricing on our website. However, we do not warrant that product descriptions or other content are error-free, complete, or current.

HYDRAX products are sports nutrition products. They are not therapeutic goods, are not intended to diagnose, treat, cure, or prevent any disease, and should not be used as a substitute for a varied and balanced diet or professional medical advice.

Product formulations, packaging, and specifications may change without notice. The most current product information is available on the product packaging at the time of delivery. Product colours and flavours may vary between batches due to natural variation in raw ingredients; this does not affect product quality.

We may change, discontinue, or limit the availability of any product at any time without prior notice. We may also limit the quantity of items that may be purchased per person, per household, or per order.

5. Orders & Pricing

All prices are listed in AUD (Australian Dollars) unless otherwise stated and are inclusive of GST where applicable. We reserve the right to change prices at any time without notice, but price changes will not affect orders that have already been confirmed.

An order is confirmed when you receive an order confirmation email from us. We reserve the right to refuse, cancel, or limit any order at our sole discretion, including orders that:

• Appear fraudulent or are suspected of payment-related fraud
• Contain errors in pricing or product information
• Are placed in quantities exceeding normal consumer purchasing patterns
• Are suspected of being purchased for unauthorised commercial resale
• Relate to products that are out of stock or subject to recall

If we cancel an order after payment has been taken, we will issue a full refund to the original payment method.

6. Product Availability

Products listed on the website are available for immediate dispatch unless otherwise marked as out of stock or coming soon. Estimated dispatch dates for any limited or special-release products are provided in good faith but are not guaranteed and may change due to manufacturing, logistics, or other factors beyond our control.

Payment is collected at the time of order. You may cancel an order for a full refund at any time before the product has been dispatched. To cancel, contact us at info@hydrax.com.au with your order number.

7. Payment

Payment is processed securely through our third-party payment provider at the time of order. We do not store credit card or payment details on our systems. By providing payment information, you represent that you are authorised to use the payment method and authorise us to charge the full order amount.

You must provide current, complete, and accurate purchase and account information for all purchases. You must promptly update your information so that we can complete your transactions and contact you as needed.

8. Shipping & Delivery

Shipping terms, rates, delivery estimates, and transit liability are set out in our Shipping & Returns page, which forms part of these Terms.

Risk of loss and title for products pass to you upon our delivery to the shipping carrier. HYDRAX is not responsible for delays, loss, theft, or damage caused by the shipping carrier unless freight insurance has been purchased.

We are not responsible for delays in delivering products which are beyond our reasonable control. If any dispatch is significantly delayed, we will notify you. You may contact us to cancel the order for a full refund if the delay is unreasonable.

9. Returns & Refunds

Returns and refund terms are set out in our Shipping & Returns page, which forms part of these Terms.

All returns require prior written approval from HYDRAX Nutrition Pty Ltd and a valid Return to Authorisation (RTA) number. Unauthorised returns will not be processed.

We do not have to give a refund or replacement if you change your mind about a purchase, except where our 30-day money-back guarantee applies (see clause 9.1). Please choose carefully.

9.1 30-Day Money-Back Guarantee

Selected HYDRAX products are covered by a 30-day money-back guarantee. If you are not satisfied with your purchase, you may contact us at info@hydrax.com.au within 30 days of delivery to request a refund. Claims lodged after 30 days of delivery will not be accepted under this guarantee.

The guarantee is subject to the following conditions: (a) it applies to one pouch or unit per product, per customer or household, and is limited to items purchased directly from hydrax.com.au (items bought from stockists, retailers, or third-party marketplaces must be returned to the original seller); (b) you must have given the product a fair trial and be able to describe how you used it, and we may ask reasonable questions before approving a claim; (c) a Return to Authorisation (RTA) number must be obtained before returning any item, and unauthorised returns may be refused; (d) we may require the product, including any unused portion, to be returned at your cost, with return postage reimbursed only where the item arrived damaged, faulty, or incorrect; (e) original shipping charges are not refundable; (f) only one approved claim per customer or household applies in any 12-month period; (g) bulk, wholesale, reseller, clearance, and promotional orders are excluded, and bundles or multi-packs are refunded pro-rata for the covered unit only, with free or gifted items returned or their value deducted; and (h) approved refunds are issued to the original payment method used at checkout and may take up to 10 business days to appear.

We may decline or withdraw the guarantee where we reasonably believe it is being misused, including repeated claims, resale of product, fraudulent or abusive conduct, or claims made in respect of orders not placed by you. This guarantee is offered voluntarily and is in addition to, and does not limit, exclude, or replace, your rights under the Australian Consumer Law.

Nothing in these Terms is intended to exclude, restrict, or modify any rights or remedies you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). You are entitled to a replacement or refund if the products are faulty.

10. Accounts & Account Security

If you create an account with us, you are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activities that occur under your account. We will not be liable for any loss or damage arising from your failure to safeguard your account information.

We reserve the right to suspend or terminate any account that we believe, in our sole discretion, violates these Terms or is being used for fraudulent or unauthorised purposes.

11. Intellectual Property

All content on the HYDRAX website — including text, graphics, logos, images, product names, formulations, trade dress, and software — is the property of HYDRAX Nutrition Pty Ltd or its licensors and is protected by Australian and international intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise use any content from this website without our prior written consent. Except where necessary in connection with shopping or placing an order, you may not copy, download, or mirror any content from this site.

12. User Conduct & Site Terms of Use

You agree not to:

• Use our website for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorised access to our systems or interfere with website operation
• Submit false, misleading, or fraudulent information
• Resell, redistribute, or commercially exploit our products without our written permission
• Use automated systems (bots, scrapers) to access our website without permission
• Conduct any systematic or automated data collection activities (including scraping, data mining, or data harvesting) without our express written consent
• Attempt to transmit any virus, Trojan horse, or other software designed to disrupt, damage, or interfere with the functioning of this site
• Use this site to transmit unsolicited commercial communications

Your use of this site is at your sole risk. The site and all products are provided "as is" and "as available" without representations or warranties of any kind, except as required by law.

13. User Content & Reviews

If you submit reviews, feedback, suggestions, or other content ("User Content"), you grant HYDRAX a non-exclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any media worldwide.

You represent and warrant that your User Content is accurate, does not violate any third party's rights, and does not contain unlawful, defamatory, or objectionable material. We may, but are not obligated to, monitor, edit, or remove User Content at our sole discretion.

14. Wholesale & Trade Accounts

Wholesale and trade enquiries are handled separately and are subject to additional terms and conditions as agreed in writing between HYDRAX Nutrition Pty Ltd and the wholesale or trade customer. Retail terms on this website do not apply to wholesale transactions.

HYDRAX reserves the right to accept or decline wholesale applications at its sole discretion and to set minimum order quantities, pricing tiers, and payment terms for wholesale accounts.

15. Product Liability & Assumption of Risk

You acknowledge that sports nutrition products carry inherent risks and that individual responses to ingredients may vary. You are responsible for reviewing product ingredients and nutritional information before consumption. You consume all products at your own risk.

HYDRAX strongly recommends consulting a qualified healthcare professional before using any sports nutrition product, particularly if you are pregnant, nursing, have a medical condition, or are taking medication.

HYDRAX products may contain allergens including milk, soy, and gluten. Please review all product labels carefully.

16. Limitation of Liability

To the maximum extent permitted by law, HYDRAX Nutrition Pty Ltd, its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of our website, products, or services.

Our total aggregate liability to you for all claims arising out of or relating to these Terms or your use of our products shall not exceed the total amount you paid for the specific product giving rise to the claim.

We do not guarantee that your use of the site will be uninterrupted, timely, secure, or error-free, or that results obtained will be accurate or reliable.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability under the Australian Consumer Law.

17. Indemnification

You agree to indemnify and hold harmless HYDRAX Nutrition Pty Ltd, its directors, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including legal fees) arising from or related to your breach of these Terms, misuse of our products, violation of any applicable law, or any content you submit.

18. Force Majeure

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by events beyond our reasonable control ("Force Majeure Event").

A Force Majeure Event includes, without limitation: strikes, lock-outs or other industrial action, civil commotion, riot, invasion, terrorist attack or threat, war (declared or not), fire, explosion, storm, flood, earthquake, epidemic, pandemic, health crisis, failure of public or private telecommunications networks, supply chain disruption, or any act of government or regulatory authority.

If a Force Majeure Event occurs, we will notify you as soon as reasonably possible. Our obligations will be suspended for the duration of the event. If the event continues for more than 30 days, you may cancel any affected order for a full refund.

19. Third-Party Links

Our website may contain links to third-party websites or services that are not owned or controlled by HYDRAX. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites. A link to any third-party site should not be interpreted as an endorsement by HYDRAX.

20. Promotional Codes & Offers

Promotional or discount codes are subject to the specific terms and conditions stated at the time of the offer. Unless otherwise stated, promotional codes cannot be combined with other offers, applied to previous purchases, or used for wholesale transactions. We reserve the right to discontinue any promotion at any time without notice.

21. Dispute Resolution

We prefer to resolve any dispute amicably. If you are not satisfied with how we have handled a complaint, please contact us at info@hydrax.com.au and we will work to find a resolution.

If we cannot resolve the dispute informally, you may wish to refer the matter to an independent alternative dispute resolution body. Both parties agree to attempt mediation in good faith before commencing legal proceedings.

22. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of New South Wales, Australia, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts of New South Wales, Australia, for the resolution of any disputes arising from or relating to these Terms.

23. Transfer of Rights

We may transfer our rights and obligations under these Terms to another organisation, but this will not affect your rights or our obligations under these Terms. You may not transfer your rights or obligations under these Terms without our prior written consent.

24. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

25. Waiver

If we do not exercise or enforce any right or provision of these Terms, this does not constitute a waiver of such right or provision. We may still enforce such right or provision at a later date.

26. Entire Agreement

These Terms, together with our Privacy Policy and Shipping & Returns policy, constitute the entire agreement between you and HYDRAX Nutrition Pty Ltd regarding your use of our website and purchase of our products, superseding any prior agreements or communications.

27. Changes to Terms

We reserve the right to update or modify these Terms at any time. The updated version will be posted on our website with a revised "Last updated" date. It is your responsibility to check these Terms periodically. Continued use of our website or services after changes are posted constitutes your acceptance of the revised Terms.
